Standard Order Agreement
This Standard Order Agreement is made and entered into between Gunnarsson Design ehf (“the Seller”) and the Buyer for the purchase of (1) moss art products (custom-made or ready-made), and/or (2) digital products or media design-related services.
The terms and conditions below govern this Agreement.
1. Product Description:
Moss Art Products
Moss art pieces are decorative items made from preserved moss, intended to be hung or mounted on a wall. They must not be watered and should not be exposed to direct sunlight. The Buyer should avoid humidity, strong temperature fluctuations, radiators, air conditioning units, and any pressure on the moss surface.
Optimal room temperature: 10–29°C
Optimal humidity: 40–60%
Digital Products
Digital products consist of files delivered electronically. They are intended for personal or commercial use only as described in the product listing.
The Buyer acknowledges that digital products are delivered in electronic form and require compatible hardware, software, and internet access to view and use.
2. Purchase Price:
The Buyer agrees to pay the purchase price for moss art products and/or digital products according to the terms stated in this Agreement.
All prices include applicable taxes unless otherwise noted.
3. Payment Terms:
For both moss art products and digital products:
The Buyer shall pay the full purchase amount at the time of ordering. Payment must be made via bank transfer or any payment method offered by the Seller.
Digital products are delivered only after full payment is received.
Moss art orders enter production only after payment is confirmed.
4. Delivery:
Moss Art Products
The Seller will make reasonable efforts to deliver moss art within the agreed timeframe. Delivery delays caused by events outside the Seller’s control do not constitute breach of contract.
The Buyer is responsible for all shipping and handling charges.
Digital Products
Digital products are delivered electronically via download link or email after payment is received.
Delivery is considered complete once the file is sent or made available for download.
5. Warranty:
Moss Art (Custom-Made & Ready-Made)
All moss art includes a 90-day warranty from the delivery date covering manufacturing defects only.
The warranty does not cover:
- natural variations in preserved moss
- normal fading or aging
- damage from sunlight, humidity, improper mounting, or misuse
- general wear and tear
Approved claims may result in repair, replacement, or partial refund.
Digital Products
Digital products do not include a warranty.
However, any technical issue that prevents downloading or accessing the files will be corrected if reported within 14 days of purchase.
After successful download, digital files are considered delivered and functional.
General Warranty Terms (For All Products)
Warranty coverage applies only to the original purchaser and is non-transferable.
The Seller is not responsible for damages caused by improper handling, installation, or environmental conditions.
6. Care & Maintenance:
Moss Art Products
The Buyer agrees to follow care instructions, including:
- Do not water, moisten, or cut the moss.
- Avoid direct sunlight.
- Avoid pressure or touching the moss surface.
- Avoid strong temperature fluctuations.
- Avoid radiators and air conditioning units.
Digital Products
Digital products require:
- compatible software/hardware
- appropriate storage and backup by the Buyer
The Seller is not responsible for data loss after delivery.
7. Limitation of Liability:
This applies to all moss art and digital products:
The Seller shall not be liable for damages caused by misuse, negligence, improper installation, failure to follow instructions, loss of data, or compatibility issues. In no event shall the Seller’s liability exceed the purchase price paid for the respective product.
8. Intellectual Property:
All intellectual property rights related to moss art designs, digital products, and design-related services remain the exclusive property of the Seller. Digital products may not be resold, redistributed, or shared unless explicitly permitted in writing.
9. Governing Law & Jurisdiction:
This Agreement is governed by the laws of Reykjavík, Iceland. Any disputes shall be resolved exclusively in the courts of Reykjavík, Iceland.
10. Entire Agreement:
This Agreement constitutes the full and complete understanding between the Seller and Buyer and supersedes all prior written or verbal agreements. By placing an order for moss art or digital products, the Buyer confirms that they have read, understood, and agreed to these terms.
